Terms of Service

Last updated: January 2024

1. Scope of Agreement

These Terms of Service ("Terms") govern the relationship between YourFlightCompensation ("we", "us", or "our") and the customer ("you") regarding the pursuit of financial compensation from airlines for flight disruptions under EC Regulation 261/2004 or other applicable air passenger rights regulations.

2. Our Services

YourFlightCompensation provides claim management services. We evaluate your eligibility, prepare the necessary documentation, and handle all communications with the airline. If necessary, we may involve legal partners to pursue the claim through court proceedings.

3. No Win, No Fee Agreement

We operate strictly on a "No Win, No Fee" basis. You are not required to pay any upfront fees. If we are successful in obtaining compensation, we will charge a service fee (Success Fee).

  • Service Fee: 30% (including VAT) of the total compensation amount received.
  • Legal Action Fee: If court proceedings are initiated, an additional fee of 15% (including VAT) may apply to cover the increased costs and risks of litigation.

If no compensation is recovered, you owe us nothing.

4. Power of Attorney

By submitting a claim, you grant YourFlightCompensation a limited Power of Attorney to represent you and act on your behalf in all matters related to the claim. This includes the right to receive payments from the airline and to negotiate settlements.

5. Customer Obligations

To process your claim effectively, you agree to:

  • Provide accurate and complete information and documentation (e.g., boarding passes, booking confirmations).
  • Inform us immediately if the airline contacts you directly or makes a payment to you.
  • Refrain from pursuing the same claim through other channels while our agreement is active.

6. Termination

You may terminate this agreement within 14 days of signing (cancellation period) without giving any reason, provided that the airline has not yet paid the compensation. After this period, termination is subject to our approval and may incur administrative costs if significant work has been performed.

7. Liability and Governing Law

Our liability is limited to the value of the potential compensation. These Terms are governed by the laws of the country where our headquarters are located, and any disputes shall be resolved in its courts.
